Wrongful Death suit filed in Collapse of Tent

A wrongful death law suit has been filed when a tent collapsed on a man at an event in Chicago, Illinois, after inclement weather moved in.

The storm approached the event with high winds and the organizers of the Wood Dale Priar Festival directed the attendees to take shelter under a tent which was improperly secured. The victim was 35 years old and was killed when the main pole of the tent fell on him.  In addition, 22 others were hurt.

In addition to the company organizing the event, the companies that managed the vent and rented the tent to the festival have also been sued.

In Fort Lauderdale, young party goers were injured when a bounce house on the beach lost its moorings and blew away in gale force winds.

Tents and other temporary structures used for events such as birthday parties have the potential to become unsafe in the event that a storm with high winds and rain moves in.  This type of weather change is not uncommon in South Florida. A lot of times, bounce houses and tents are assembled by companies who lease out this equipment and these temporary structures are not properly secured to withstand this.  Should this occur, the consequences can be devastating.

Florida’s Keys are still the most dangerous boating location

images[6]-thumb-333x258-45661The Florida Fish and Wildlife Conservation Commission’s report on boating accidents for 2011 is in and the Florida Keys has retained its title as Florida’s most dangerous location for boating injuries and deaths, with 93 significant accidents on the water in 2011.

According to the commission, there was a 20 percent increase over the 77 boat accidents reported in 2010. There were 6 boating deaths and 66 injuries in the Keys 2011. Accidents throughout the state of Florida have increased. Overall, Florida marine officers statewide logged 742 reportable accidents and 67 deaths. Miami-Dade County came in a close second on the list with 75 boating accidents.

Careless operation and alcohol usage were present in a significant number of these accidents.

The accidents in the Keys range from powerboats involved in races to fishermen killed in when their flats boat collided with a utility pole at a bridge. Falling overboard and drowning was the most common cause of death in boating accidents.

Although accidents are on the increase, Florida’s boat registrations continued to decline, most likely due to the economy.

Fort Lauderdale Beach sunbather run over by truck

images[5]-thumb-333x250-39845Yet again, we hear about another person run over by a large vehicle while on a South Florida Beach. This calls into question the wisdom and protocol of allowing vehicles like pick-up trucks on tourist laden sandy beaches.

A North Carolina woman was recently injured while sunbathing on the beach in Fort Lauderdale after an Ocean Rescue pickup drove ran over her. She has alleged that the City of Fort Lauderdale was negligent by allowing large vehicles to be driven on the beach.

Fort Lauderdale Mayor Jack Seiler said the city will probably review its rules regarding government vehicles being driven on beaches. The truck’s driver, a veteran Rescue lieutenant, was placed on leave pending a review.

Large vehicles such as pickups have a limited view of sunbathers lying on the sand. This usage has raised concerns that these vehicles can’t be driven on the beach as safely as all-terrain vehicles (“ATV’s“), which offer far more viewability and maneuverability. While some lifeguards say these types of trucks are necessary for transportation in emergencies to carry medical equipment, such as backboards, defibrillators and first-aid kits, there is no reason why an all terrain vehicle (“ATV”) cannot similarly be employed. ATV’s offer a far better view of sunbathers and a trailer can be attached for carrying equipment or even victims.

Though Fort Lauderdale officials claim to have no knowledge of any other sunbather being run over on the beach, there have been similar incidents reported on other Florida beaches. Any time someone is struck by a vehicle on a sandy beach, questions about negligent operation of the vehicle come into question.
